Exactly. It is still illegal. Just they have no established way to deal with it. So they just overlook it. Besides, if they tried to deal with all the underage sex cases in the nation... well they couldn't. Its not logistically possible to. Plus it has a low priority compared with busting drug dealers and catching murderers.

Haha. They have it illegal because then you MIGHT have a child. And if you do then unless you get an abortion or put it up for adoption you have to take care of it. Ruins your life. Yada yada. At least that is their thought proccess.
