Shouldn't, if you see something coming out about Banhammer, then you should be worried. But I don't think a dashboard update would ban you. I think it is just the whole facebook think isn't it?
it either the facebook update or it's a tweak for HD movies, they said something about in OXM (Official Xbox Magazine)

Yea, either way updates shouldn't ban you. Unless there is a hidden patch or banhammer update within it (highly unlikely though because it is usually announced).

If your worried then why don't you wait to get your xbox flashed until after the update?
will it matter?
like i read something saying that all the flashed DVD drive is actually doing is tricking the motherboard into believing that the burnt games are real so now im pretty sure i should have nothing to worry about.

Don't worry, dashboard updates don't effect the dvd drive. But what I do to stay safe is I stay off live for a day or so. Then I check on xbox360iso to see if any threads pop up about people being banned.
In short: Play it safe, and let the tards get banned and listen for their complaints.
